Protest Terms of Service

Read this first. Optionality Protest is a software tool that helps you generate a property tax protest document. We do not represent you. You are the filer of record. We are not a registered Texas Property Tax Consultant, attorney, or agent. By using this service, you agree you alone are responsible for filing your protest and appearing at any hearing.

1. Acceptance of Terms

By using the property tax protest service offered by Optionality Ventures LLC at /protest (the "Protest Service"), you agree to be bound by these Protest Terms of Service. These Terms supplement, and where in conflict control over, the general Optionality Terms of Service for matters specific to the Protest Service. If you do not agree, do not use the Protest Service.

2. Description of the Protest Service

The Protest Service is a self-service software tool that:

  • Accepts information about your residential property in a supported Texas county (currently Travis, Williamson, Harris, Tarrant, Dallas, and Bexar);
  • Uses publicly available data and AI-generated comparable property estimates to produce an informational fair-market-value estimate;
  • If purchased, generates a written protest document (a "Protest Packet") formatted for filing with your county appraisal district (such as TCAD) and its Appraisal Review Board ("ARB").

The Protest Service does not file documents on your behalf, does not appear at hearings on your behalf, and does not represent you in any administrative or legal proceeding.

3. You Are the Filer of Record

Texas Tax Code § 41.41 grants every property owner the right to protest the appraised value of their own property. Optionality Ventures LLC is not a property tax consultant, attorney, or agent under Texas Occupations Code Chapter 1152 or any other applicable statute. We do not appear as your representative on Form 50-162 or any equivalent form. You acknowledge and agree that:

  • You alone are the protesting party of record;
  • You alone sign, file, and submit any protest document we generate;
  • You alone appear at any informal review, ARB hearing, or subsequent proceeding;
  • No attorney-client, agency, fiduciary, or professional advisor relationship is created between you and Optionality Ventures LLC by your use of the Protest Service.

4. Not Legal, Tax, or Financial Advice

The output of the Protest Service is informational only. Nothing produced or displayed by the Protest Service constitutes legal advice, tax advice, financial advice, or professional appraisal. The fair-market estimate, comparable properties, and Protest Packet content are generated using statistical models and AI; they may be incomplete, inaccurate, or wrong. You should consult a licensed property tax consultant, real estate attorney, or certified appraiser before relying on any output for a material financial decision.

5. Fees and Refunds

The fair-market-value estimate is provided free of charge. Generation of the Protest Packet costs $50 (USD) per property per tax year, charged via Stripe at the time of order. Because the Protest Packet is a custom digital document delivered immediately upon payment, all sales are final once the document has been generated and made available for download.

If, due to a technical failure on our side, we fail to deliver a downloadable Protest Packet within 24 hours of successful payment, you may request a full refund by emailing protest@optionalityhq.com.

6. No Outcome Guarantee

Property tax protests are decided by independent county Appraisal Review Boards. Optionality Ventures LLC has no control over, and makes no warranty, representation, or guarantee regarding, the outcome of any protest. Past results, statistics, or savings figures shown in marketing materials are illustrative only and do not predict your individual outcome.

7. Filing Deadline

Texas property tax protests must be filed by May 15 of the relevant tax year, or 30 days after the date the appraisal notice was delivered, whichever is later (Texas Tax Code § 41.44). Determining and meeting the applicable deadline for your property is your sole responsibility. We strongly encourage filing several days before the deadline.

8. Accuracy of Information You Provide

You agree that all information you submit through the Protest Service — including your address, assessed value, square footage, and contact details — is true and accurate to the best of your knowledge. False, misleading, or fraudulent submissions to a government body are your responsibility and may carry legal consequences for you. We have no obligation to verify your inputs.

9. Use of AI and Public Data

The Protest Service uses third-party large language models and publicly available property data to produce comparable estimates and draft language. These outputs may contain errors. You agree to review the Protest Packet carefully before signing or filing it. Any decision to file the document — or to modify it before filing — is yours alone.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Optionality Ventures LLC's total liability arising out of or relating to the Protest Service, in contract, tort, or otherwise, shall not exceed the amount you paid for the Protest Packet at issue ($50). Optionality Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to denied protests, increased assessments, missed deadlines, lost time, or attorney fees.

11. Indemnification

You agree to indemnify and hold harmless Optionality Ventures LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your filing of any document generated by the Protest Service, your statements to any county appraisal district or ARB, your missed deadlines, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

13. Changes to Terms

We may update these Protest Terms from time to time. The "Effective date" above will reflect the date of the most recent change. Continued use of the Protest Service after the effective date constitutes acceptance of the updated Terms.
